Living in Canada while managing property in India can be challenging. A Power of Attorney (POA) allows a trusted person in India to handle specific property matters on your behalf, such as sale, purchase, registration, rental or property management.
The key is to give only the authority that is actually required and follow the correct Canadian and Indian procedures.
Before preparing a POA, clearly decide what your Attorney needs to do.
For example:
“I authorise my brother to complete the sale and registration of my apartment in Pune.”
Avoid giving authority over all your properties when only one transaction is required.
NRIWAY Principle:
Specific Purpose → Specific Property → Specific Authority
GPA (General Power of Attorney): Suitable when broader, continuing authority is genuinely required.
SPA (Special Power of Attorney): Suitable for a specific property or transaction.
For a one-time property sale, an SPA can provide better control by limiting the Attorney's powers.
A professionally prepared POA should include:
Always have the final document reviewed by a qualified lawyer.
Canada joined the Hague Apostille Convention on January 11, 2024. Therefore, older POA procedures may no longer apply.
The authentication process can depend on your province, nationality and intended use. Recognised authorities include those in Ontario, Alberta, British Columbia, Saskatchewan and Quebec.
Check the current requirements applicable to your province before proceeding.
The process may differ depending on whether you are:
Follow the applicable Indian Mission and Canadian authority requirements for your circumstances.
Depending on the applicable route, you may need:
Where required, follow the current BLS/Consular submission process.
After completing the Canadian-side formalities:
Draft → Execute → Authenticate/Apostille → Send Original → India-side Formalities → Registration/Use
Keep copies of the POA and authentication documents for your records.
An apostille does not automatically complete the Indian Property transaction. Depending on the state and transaction, stamp duty, adjudication, registration and other legal or tax requirements may apply.
Check the requirements for the specific property and transaction.
If your Attorney is authorised to sell your property, carefully decide whether they should have authority to receive or control the sale proceeds.
Consider:
A lawyer and CA should advise on the appropriate structure.
Define Purpose → Draft POA → Execute & Witness → Apostille/Authenticate → Send to India → Stamp/Adjudicate → Register/Use
