According to US immigration regulations, all J-1 visa holders must have two years of home (India) residency before filing for an H1B visa, i.e., a work visa. J-1 visa holders must submit a NORI Certificate to US authorities to do so. Applicants who are remaining in the United States often require a J1-waiver, for which they must apply for a NORI Certificate at the Indian Missions/Posts in the United States. Those who have returned to India may apply for this Certificate at the CPV Division, Ministry of External Affairs, New Delhi. Applicants residing in a third country must apply at the relevant Indian Mission/Post.
The Consulate retains the authority to refuse attestation of papers whose contents are undesirable or violate the Rules. The Consulate does not certify any document issued by Indian authorities. Suppose any document issued by authorities in India (such as birth and death certificates, affidavits, diplomas, marriage certificates, and educational credentials issued by authorities in India) must be submitted to sources in the United States.
