A Rent Agreement is the legal record of the commercial understanding between the owner and tenant/licensee.

In Pune, a professionally prepared agreement should address parties, premises, rent, deposit, tenure, notice, lock-in, permitted use, maintenance, termination and other agreed obligations and should comply with the applicable Maharashtra registration and stamp-duty requirements.

 

1. Is an 11-Month Agreement Required to Be Registered?

This is the first misconception to clear.

For agreements covered by Section 55 of the Maharashtra Rent Control Act, 1999, agreements for leave and licence or letting of premises are required to be in writing and registered. The provision also places responsibility for registration on the landlord.

Therefore:

11 months does not automatically mean “no registration.”

The legal requirement should be determined from the applicable law and the actual transaction not simply from the number of months.

 

2. Pune Rent Agreement: What Should Be Covered?

A professionally drafted agreement should clearly establish:

Who is the owner and who is the tenant/licensee?

PROPERTY

What exactly is being given for occupation?

RENT

How much, when payable and by what method?

DEPOSIT

How much, and what are the agreed settlement terms?

TENURE

When does the agreement start and expire?

LOCK-IN

Is there a lock-in period and what are its contractual consequences?

NOTICE

How much notice is required for termination?

MAINTENANCE & REPAIRS

Who is responsible for what?

PERMITTED USE

Residential use, commercial use or another agreed purpose?

SUBLETTING

Is further occupation/subletting permitted?

TERMINATION & HANDOVER

What happens when the arrangement ends?

If it affects money, possession or termination put it in writing.

 

3. Pune Rent Agreement Calculator

For an applicable leave-and-license agreement not exceeding 60 months, Article 36A of the Maharashtra Stamp Act provides a stamp-duty formula based on specified components, including rent/licence fees, non-refundable deposit/premium and the applicable interest component on refundable security deposit.

Use these inputs:

Monthly Rent: ₹ ________

Agreement Period: ______ months

Refundable Deposit: ₹ ________

Non-refundable Deposit/Premium: ₹ ________

Basic statutory calculation:

Total Rent = Monthly Rent × Number of Months

Deposit Interest Component = Refundable Deposit × 10% × Period/12

Applicable Stamp-Duty Base = Total Rent + Non-refundable Deposit/Premium + Deposit Interest Component

Stamp Duty = 0.25% × Applicable Base

This is a calculation framework, not a quotation. The final government amount should be confirmed against the exact transaction and current applicable procedure.

 

4. Example: Pune Rent Agreement

Suppose:

Rent: ₹30,000/month

Term: 11 months

Refundable Deposit: ₹2,00,000

Non-refundable Deposit: ₹0

Total Rent

₹30,000 × 11 = ₹3,30,000

Deposit Interest Component

₹2,00,000 × 10% × 11/12

= ₹18,333.33

Applicable Base

₹3,30,000 + ₹18,333.33

= ₹3,48,333.33

Illustrative Stamp Duty

0.25% × ₹3,48,333.33

= approximately ₹871

Registration fee and professional/service charges, if applicable, are separate.

 

5. Stamp Duty ≠ Registration Fee

This distinction matters when calculating the actual cost.

Professional documentation/registration assistance, if applicable

A customer should always know what is a government charge and what is a service charge.

 

6. Registration vs Notarisation

Another common mistake:

“We'll just get it notarised.”

Notarisation and registration are different legal processes.

Where Maharashtra law requires registration, notarisation should not be assumed to be a substitute.

The right question is:

“What formalities apply to this particular Pune property and agreement?”

—not—

“What did someone else do for their 11-month agreement?”

 

7. Current-Clause Checklist: Don't Use an Old Template Blindly

A professional agreement should be reviewed for current commercial and legal requirements.

Pay particular attention to clauses covering:

Before handing over possession, ask:

Have I correctly identified the parties?

Are rent and deposit unambiguous?

Is the expiry date correct?

Are notice and lock-in terms clear?

Who pays which expenses?

What happens if either party defaults?

Have the applicable stamp-duty and registration requirements been checked?

Your property is valuable.

Your documentation should reflect that value.

 

9. For Pune Tenants

Before signing:

Read the termination clause.

Understand the lock-in.

Confirm the deposit terms.

Check maintenance obligations.

Check permitted use.

Check additional charges.

Verify the person executing the agreement.

Keep the executed agreement safely.

Don't read the agreement only when you want to leave.

Read it before you enter.

 

10. For NRI Owners in Pune

If the owner is overseas, additional practical questions may arise:

Who will coordinate locally?

Who is authorised to act?

Is a Power of Attorney involved?

How will the agreement be executed?

What identification and verification requirements apply?

The correct process depends on the circumstances and applicable law.

You may live abroad. Your Pune property still needs India-ready documentation.

 

11. The Pune Rent Agreement — 7-Point Test

Before signing, ask:

1. WHO are the parties?

2. WHAT property is being given?

3. HOW MUCH are rent and deposit?

4. HOW LONG is the agreement?

5. WHEN can either party terminate?

6. WHO pays maintenance, utilities and repairs?

7. WHAT Maharashtra formalities apply?

If these seven answers are clear, you are starting from a much stronger position.
